Gym man cleared of voyeurism
Sonn Macmillan Walker acted for a man in his twenties accused of attempted voyeurism. Our client admitted putting a mobile phone around the door of the female changing room of a public gym to view the interior of the room.
The issue was whether he had done so to view women in a state of undress or merely to check if the room was empty. We obtained a psychological report on our client showing that he exhibited many traits consistent with autism. In addition, we made full use of prosecution unused material showing that our client had arranged to meet his friends at the gym that day (not something he would have done if he had intended to observe people in the changing room). The judge, giving his reasons immediately, found our client not guilty on the basis both of his consistent and honest evidence and the material we put forward on his behalf.
