In the Magistrates’ Court, you may be entitled to legal aid subject to a means and merits tests. Currently, legal aid in the Crown Court is not means tested, however, a judge may make a Recovery of Defence Costs Order at the conclusion of a case by which the defendant can be ordered to pay the legal costs to which his solicitor and Counsel are entitled under the legal aid scheme. The government has introduced a means testing pilot in certain Crown Courts. Many clients prefer to instruct us on a private fee paying basis and we undertake a considerable amount of work under that arrangement.
