Extradition to Poland refused by Westminster Magistrates’ Court

Mr S was arrested on a conviction warrant to serve a sentence for two offences of supply of a controlled drug in Poland. Polish authorities sought his extradition to serve the sentence.

Age of conviction

These offences were committed over 18 years ago and there was a significant delay on behalf of the Polish Authorities of almost 13 years before an EAW was applied for. Mr S was living an open life in the UK, supporting his partner and 7 month old son and having established his own business. The District Judge upheld our argument that there would be a disproportionate interference with his rights under Article 8 ECHR and discharged him from the extradition proceedings.

No appeal by CPS

The CPS decided not to appeal this decision. Mr S has therefore  been able to return to his young family. He continues to support them and run his successful business.
