Hackney abandon prosecution for breach of a listed building enforcement notice

The firm acted for three defendants charged with failing to comply, for over 5 years, with a listed building enforcement notice

The notice required the removal of UPVC windows and railings at a property in Dalston.

Whilst Hackney could prove the failure to comply, it was argued on behalf of all three defendants that the notice was a nullity because the council had issued a single notice relating to different parts of the land, which is comprised in more than three different legal titles. Although not conceding that the notice was a nullity, the proceedings were withdrawn against all three defendants.
