Specialist rape prosecutions require specialist defence solicitors too

On 8 January 2015 the DPP announced a new, revised protocol for the CPS dealing with rape allegations.

As a result it is anticipated there will be an increase in rape prosecutions of 30% – an increase of around 550 rape trials and 650 decisions to prosecute. The DPP stated, “I am determined to ensure our Rape and Serious Sexual Offence (RASSO) Units have the skilled lawyers and the essential tools they need to do the job and work effectively with specialist Police rape teams.”

While an increase in prosecutions – where the evidence justifies it – is to be applauded, there will be suspects and defendants who are concerned that, while they are being investigated and prosecuted by experts in this field, they must ensure they are represented by similarly specialist lawyers. Only where there is a level playing field will justice be properly served.
