Community Resolution Secured for Fraud Offences

Our client was arrested and held at Brixton Police Station for offences of fraud by false representation and handling stollen goods.

 

Our client was only 21 years of age and of good character, having never been arrested or convicted before. His main concern was the possibility of having a conviction noted on his criminal record. SMW provided advice and assistance to our client whilst in custody and represented him in interview.

 

Our client provided a prepared statement accepting partial involvement in the alleged offence.  

 

Having made representations, the police were persuaded to deal with this matter by way of an out of court disposal rather than sending the matter to the CPS for a charging decision.

 

The matter was resolved the same day by way of a community resolution, and it was decided that no further action would be taken in respect of the offence of handling stollen goods. Our client was released from custody a few hours later. His family were delighted.

 

This meant our client avoided likely proceedings or having to go to court as well as the risk of having a dishonesty conviction.
