Defence Evidence Secures Offer of No Evidence in Domestic Abuse Case

Our client, EB, faced two allegations of assault occasioning actual bodily harm, together with allegations of non-fatal strangulation and threats to kill. We secured EB’s release on bail, then conducted a detailed review of the prosecution evidence and the circumstances surrounding the allegations.

Our client instructed that a series of audio recordings made during the relationship may assist his case. We had these recordings translated and transcribed, then carefully analysed alongside EB’s instructions. We compiled the material into a comprehensive jury bundle so that the context, content and significance of the recordings could be presented clearly and persuasively to the Court.

The complainant did not attend court despite being summonsed. More significantly, the recordings raised substantial concerns about the reliability of the allegations. Having reviewed the material, the prosecution acknowledged that the recordings appeared to show a willingness by the complainant to give an untruthful account to the police and the Court, as well as an apparent admission of assaulting EB.

After considering the translated recordings, transcripts and supporting material, the prosecution offered no evidence on all charges.

The proceedings concluded without the need for a trial, allowing EB to preserve his good character.
