Defence resists SHPO and secures suspended sentence following partial acquittal in two count sexual assault case

We represented L, a young man of good character, who faced two serious sexual assault allegations at Inner London Crown Court, arising from separate complaints said to date back several years.

Our client maintained his innocence and the case proceeded to trial. The defence case involved careful and detailed preparation including careful cross-examination exposing inconsistencies in the prosecution case. The outcome was a significant one: the client was acquitted on one count and convicted on the other, with sentence adjourned for the preparation of a pre-sentence report.

We undertook equally careful preparation for sentence gathering mitigation material and character evidence. Meticulous sentence preparation helped secure our client with a suspended sentence order rather than immediate custody on the remaining account. We also resisted the prosecution’s application for a Sexual Harm Prevention Order, arguing that such an order was unnecessary in the circumstances.
