One count of rape found not guilty after retrial

We represented a client charged with a single count of rape. It was said that after an evening of drinking and celebrating, he raped a friend while she was sleeping.

Our client denied this on the basis that she was consenting at the time. He submitted a not guilty plea, and his trial was listed to take place at Southwark Crown Court.

The evidence against him included the complainant’s account as well as the account of her friend who was in the room at the time. We requested additional evidence that we considered in disclosure and examined it for inconsistencies throughout. We also had our client psychologically assessed to ensure that our client’s needs were accommodated in Court, and provide mitigation if necessary.

At the first trial, the jury were unable to come to a majority decision, resulting in a hung jury. The Crown then sought to proceed to re-trial. We made a full bail application that allowed our client to be released from custody while he awaited his re-trial.

After the re-trial took place, our client was  found not guilty of the allegation. He was immensely relieved and stated:
