Success Opposing a MAPPA Disclosure of Previous Convictions

Following our client’s conviction for historic sex offences, he was made subject to police notification requirements and Multi Agency Public Protection Arrangements (MAPPA).  Our client was advised by probation that a decision had been made to disclose his previous convictions to his neighbour and that this would be done in the upcoming days.

We were able to urgently contact the probation service making submissions as to why the disclosure, in the circumstances of the case, was not urgent, and to remind them of the guidance which should allow an offender the opportunity to make representations. As a result, the disclosure was delayed in order for detailed representations to be made.

A number of months later, probation again indicated that disclosure would be made and this was due to be carried out the following day, having not given our client any prior warning. In response, we immediately contacted probation and submitted a pre-action letter with detailed representations and proposing a judicial review to the Secretary of State for Justice. As a result, it was subsequently confirmed that the disclosure would not be made.

Our client and his family were both very relieved and pleased with the outcome.
