Successful Representation of British Swiss Businessman in Private Criminal Prosecution

Our client was accused of conspiracy to defraud two Swiss gold‑commodity trading companies of $1.5 million. He consistently denied any wrongdoing, maintaining that he had been misled by two sophisticated fraudsters who were charged alongside him. The allegations dated back to December 2019, and a conviction would have carried the risk of a lengthy custodial sentence and severe reputational damage.

Our defence team developed a robust and meticulously prepared strategy. We secured a court order compelling the disclosure of key material that undermined the prosecution’s case. Through diligent analysis, we obtained contemporaneous telephone messages and banking records that supported our client’s account.

Before the commencement of the trial, the two co‑accused were convicted of similar offences in separate criminal proceedings. Following a review of the evidence, the prosecution offered no evidence, bringing the protracted proceedings to an end and leaving our client fully vindicated.
