Victim’s Right to Review Leads to Reconsideration of Prosecution Decision

Sonn Macmillan Walker’s client was seriously injured in a road traffic collision. Following a decision not to prosecute the suspected driver, SMW made representations to the CPS on the victim’s behalf under the VRR scheme, contending that the CPS decision was legally flawed.

After a lengthy delay while the police further investigated the circumstances surrounding the collision, the CPS reversed its decision and authorised charges of perverting the course of justice, causing serious injury by dangerous driving and causing serious injury while driving whilst disqualified.

The CPS apologised for the distress caused to our client by its previous decision.
