£10,000 benefits overpayment prosecution dropped

By Amy Cox  |  06.10.2016

We managed to persuade the local authority to impose an administrative penalty on our client rather than prosecute him.

Mr A was due to appear before Snaresbrook Crown Court for trial charged with failing to declare a change in his circumstances, resulting in an overpayment of benefits of over £10,000. Cecilia Goodwin, the solicitor with conduct of his case, made written representations to the prosecution arguing that it was not in the public interest to pursue the matter to trial. She successfully persuaded the prosecution to agree to deal with the case by way of an Administrative Penalty instead of prosecution.
