Client facing life imprisonment acquitted of serious sexual offences
This was a serious case where our client, a young man aged 25, was charged with rape, sexual assault, and assault by penetration.
The case was complicated by the fact that our client had two previous convictions for similar offences. As a result of those offences, he was facing a life sentence with a minimum term in the region of 20 years imprisonment if convicted.
Our case preparation involved careful consideration of hundreds of messages between our client and the complainant, both on social media and various other messaging platforms. We also instructed a phone expert and a forensic causation expert in respect of injuries.
Following legal argument, the Court excluded a potentially unhelpful comment alleged to have been made by the defendant upon arrest on the basis that the police had breached the Police and Criminal Evidence Act 1984.
After a 10 day trial, our client was acquitted of all charges that he faced. The client felt supported during the preparation for a very difficult trial and was grateful for the representation he received.
This case was prepared by Head of Litigation Amy Cox, who was assisted by trainee solicitor Milly Blunt. Briony Molyneux of Crucible Chambers was instructed.
