Extradition to Romania refused

Extradition was refused by Westminster Magistrates' Court for AB, a Romanian national who was wanted to serve a custodial sentence of 3 year and 3 months for offences of kidnap, a public order offence and possession of a pepper spray.

AB had established a life in the UK and lived with his wife and 7 year old son who suffers from severe autism.  Dr Sharon Pettle (Child psychologist) was instructed to prepare a report concerning the impact on the family, particularly AB’s son.  The District Judge upheld the Article 8 (ECHR) challenge and discharged AB on the basis that the impact of AB’s extradition and separation from his son would create the risk of deep and profound damage, from which his son might not recover.
