No further action taken against client attacked by member of police staff

Our client had been arrested for common assault following an altercation with a member of police staff who spotted our client taking pictures next to a police car and challenged him about it. He became increasingly aggressive and tried to hit our client. Our client used force to defend himself but, it needed members of public and the police to intervene to break the incident up.

Despite clearly being the victim of an attack, our client was arrested and taken to Holborn Police Station. This was his first time being arrested and interviewed and he was nervous at the idea of answering police questions.

Luke advised our client that the most convincing means by which to put forward his defence in police interview and weaken any future prosecution case, would be to give a full comment interview. Luke advised him to answer questions succinctly and in a matter-of-fact way. He also reassured our client  that we could stop the interview at any time if he wanted to put forward his account in the form of a prepared statement if he found police questioning too onerous.

Our client gave a full comment interview and several weeks later, police decided to take no further action against him. Our client gave us very positive feedback in which he said that the advice he had received had put him at ease and helped him through a very trying situation.
