Serious Injury Caused By Dangerous Driving: Immediate Custody Avoided

We recently acted for a client charged with causing serious injury by dangerous driving. The case involved catastrophic injuries to both the victim and our client, leaving both with complex and life long medical needs.
Our client was extradited from Poland to the UK on warrant to appear before Lewes Crown Court, having previously pleaded guilty and had his case committed for sentence. Despite these factors, we were able to secure post-conviction bail and a suitable adjournment to prepare for sentence.
There were several aggravating factors in this case, which included our client being significantly over the limit both with respect to the alcohol consumed and speed during the drive. The vehicle, which was not his own, was destroyed.
We prepared comprehensive mitigation, including translations of heartfelt statements from family and friends, a letter expressing deep remorse, and evidence of our client’s good character and driving history. This preparation was instrumental in achieving the outcome of a two-year custodial sentence, suspended for two years. In addition, our client was disqualified from driving for three years and will be required to pass an extended driving test before regaining his licence.
The offence is serious, carrying a starting point is typically four years immediate imprisonment. As such, this is an extremely favourable outcome for our client, who has complex healthcare needs that he can continue to take care of in the community.
